Understanding The "Child Custody" Rules In Illinois

 

 

In 2015, Illinois lawmakers optioned to change the Illinois Marriage and Dissolution of Marriage Act. Terms like child custody and visitation were changed and are now referred to as "parental responsibilities," "parentage," or "parenting time."

Previously, both parents decided joint custody arrangements. Under the new law, "parental responsibilities" are generally assigned to a specific parent by the court.

In addition, courts will no longer assign "primary physical possession" of a child to one parent and "residential custody" to the other. Under the new law, neither phrase is used. Today, the courts apply factors based on what is in the best interest of the child to determine the parenting schedule for a particular situation.
